1. Acceptance of Terms
By accessing or using Kore ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and Kore. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the updated Terms.
2. Description of Service
Kore is a construction management platform that provides tools for:
- Managing multiple construction sites from a single dashboard
- Tracking financial transactions (income and expenses)
- Managing employee shifts and time tracking
- Storing and organizing receipts and invoices
- Generating financial reports and profitability analytics
- Managing employee assignments to construction sites
- Tracking wage history and calculating earnings
The Service operates as a multi-tenant platform, meaning each business's data is isolated and secure from other businesses using the platform.
3. User Accounts and Registration
3.1 Account Creation
To use the Service, you must create an account by providing:
- A valid email address
- A secure password
- Accurate and complete information about yourself and your business
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Using a strong, unique password
3.3 User Roles
The Service supports two user roles:
- ADMIN: Business owners with full access to all features, financial data, and user management
- EMPLOYEE: Limited access to assigned sites, own shift records, and own receipts
4. User Responsibilities
You agree to:
- Provide accurate, current, and complete information when using the Service
- Maintain and promptly update your account information
- Ensure the accuracy of all financial data, transactions, and records you enter
- Comply with all applicable laws and regulations in your use of the Service
- Use the Service only for lawful business purposes
- Respect the privacy and data of other users within your business
- Not share your account credentials with others
- Notify us immediately of any security breaches or unauthorized access
5. Acceptable Use Policy
You agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Transmit any viruses, malware, or malicious code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers connected to the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Upload content that infringes on intellectual property rights
- Upload content that is defamatory, obscene, or harmful
- Attempt to access data belonging to other businesses (violation of multi-tenant isolation)
6. Financial Data Accuracy
You are solely responsible for:
- The accuracy of all financial data, transactions, and records you enter into the Service
- Ensuring all monetary amounts are correctly entered
- Verifying the accuracy of calculations and reports generated by the Service
- Maintaining proper accounting records in accordance with applicable laws
- Consulting with qualified professionals for tax, accounting, or legal advice
Note: The Service stores monetary amounts as integers (in cents) to ensure precision. While we strive for accuracy, we do not guarantee that all calculations are error-free, and you should verify critical financial information independently.
7. Receipt and Image Uploads
When you upload receipts, invoices, or other images:
- You retain ownership of all uploaded content
- You grant us a license to store, process, and display the content as necessary to provide the Service
- You are responsible for ensuring you have the right to upload the content
- You must not upload content that violates any laws or third-party rights
- We reserve the right to remove content that violates these Terms
8. Intellectual Property
8.1 Our Intellectual Property
The Service, including its design, features, functionality, and content, is owned by Kore and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.
8.2 Your Content
You retain ownership of all data, content, and information you upload or enter into the Service. By using the Service, you grant us a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing the Service.
9. Payment Terms
Current Status: The Service is currently available without payment. We reserve the right to introduce subscription fees or other payment requirements in the future.
Future Payment Terms: If we introduce payment requirements:
- We will provide at least 30 days' notice before implementing payment requirements
- Subscription fees will be clearly disclosed before you are charged
- You may cancel your subscription at any time
- Refund policies will be clearly stated at the time of payment implementation
- Payment processing will be handled by a secure third-party payment processor
- Your payment information will be processed in accordance with our Privacy Policy
We will update these Terms to include detailed payment terms when payment functionality is implemented.
10. Service Availability and Modifications
We strive to provide reliable service but do not guarantee:
- Uninterrupted or error-free operation of the Service
- That the Service will meet all your requirements
- That defects will be corrected
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time
- Perform maintenance that may temporarily interrupt service
- Update features, functionality, or user interface
- Change pricing or payment terms (with appropriate notice)
11. Termination
11.1 Termination by You
You may terminate your account at any time by contacting us at support@getkore.ca. Upon termination, your access to the Service will cease, and we will handle your data in accordance with our Privacy Policy.
11.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent, illegal, or harmful activity
- You fail to pay required fees (when payment is implemented)
- We are required to do so by law
We will provide reasonable notice before termination, except in cases of serious violations or legal requirements.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you paid nothing)
- We are not responsible for financial losses resulting from inaccurate data entry or calculations
- We are not liable for data loss, though we maintain regular backups
13. Indemnification
You agree to indemnify, defend, and hold harmless Kore and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any law or third-party rights
- Content you upload or transmit through the Service
14. Dispute Resolution
These Terms are governed by the laws of Canada and the province in which Kore operates. Any disputes arising from these Terms or your use of the Service shall be resolved through:
- Good Faith Negotiation: The parties will attempt to resolve disputes through good faith negotiation
- Mediation: If negotiation fails, disputes may be resolved through mediation
- Arbitration or Litigation: As a last resort, disputes may be resolved through binding arbitration or in the courts of Canada
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last updated" date
- Sending an email notification (for significant changes)
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
